The Holy Quran is a book of principles and guidelines. The solution for every kind of problem is given in the Holy Quran in the form of principles and guidelines. The scholars and the Imams extract and deduce a particular ruling from it in light of the principles. Each and every issue has not been mentioned separately, but a thumb rule has been given in light of which the ruling of a particular issue can be deduced. For e.g., the issue of bearing the expenses of the delivery of the wife, hospital charges, etc. has not been mentioned explicitly in the Holy Quran. However the Holy Quran does say:

And treat them honorably. Surah Nisa (4:19)

Similarly, the Holy Quran has mentioned the sacred teachings of the Holy Quran and His excellence at various places in the Holy Quran and has ordered us to describe the greatness and excellence of the Holy Prophet (Sallallahu alaihi wa sallam). Through this basic principle, we have gotten the law that mention of the greatness of the Holy Prophet (Sallallahu alaihi wa sallam) should go on all the time. On special days, it should be done with all the more fervor.

There is a verse of the Holy Quran:

O People of the Book! Indeed there has come to you Our Messenger who (clearly) unfolds to you many such things from the Book as you have been concealing and who overlooks many of (your) wrongs (too). There has indeed come to you a light from Allah (i.e., Muhammad [blessings and peace be upon him]) and an Enlightening Book (i.e., the Holy Quran). Surah Maida (5:15)

He said that Almighty Allah has addressed the People of the Book

Almighty Allah has first mentioned the Mawlid of the Holy Prophet (Sallallahu alaihi wa sallam) and then the Seerah of the Holy Prophet (Sallallahu alaihi wa sallam) and has finished the verse with the mention of the Mawlid of the Holy Prophet (Sallallahu alaihi wa sallam). Thus, Almighty Allah says at the end of this verse:

The manner and tone of the Holy Quran tells us that to understand the life of the Holy Prophet (Sallallahu alaihi wa sallam) and act upon it, the mention of the Mawlid of the Holy Prophet (Sallallahu alaihi wa sallam) is also very important. To thank Almighty Allah for this great bounty, this is very important.

The glimpses of these teachings of the Holy Quran are seen in the life of the Companions as well. In all the books of Hadith, one can find the mention of Mawlid of the Holy Prophet (Sallallahu alaihi wa sallam) and the excellence of the Holy Prophet (Sallallahu alaihi wa sallam). If the Companions had not described the greatness and excellence of the Holy Prophet (Sallallahu alaihi wa sallam) in their gatherings, how would they be present in the canons of Hadith?

The Companions would make profuse mention of the Mawlid of the Holy Prophet (Sallallahu alaihi wa sallam) and His greatness. No day would pass when the Holy Prophet (Sallallahu alaihi wa sallam) wouldn’t be mentioned. They would mention Him each and every moment and each and every day of the year. Would they have not described the greatness of the Holy Prophet (Sallallahu alaihi wa sallam) on the occasion of Mawlid itself? Surely, their practices wouldn’t have changed.

Thus, in light of the Holy Quran and Hadith, to shake the Ummah from its slumber of heedlessness and to enthuse them, the scholars have declared this a commendable act. Especially on the occasion ofMawlid, mention the Holy Prophet (Sallallahu alaihi wa sallam) and become aware of His teachings so that through its blessings, the remaining 11 months are also spent acting upon the Shariah.

Answer: Included among the manners of visiting graves is that one should enter from the feet side of the grave and stand in such a way that one's face should be before the deceased and the Qiblah at the back. Then one should greet the deceased with ""Salaam." In the light of the Hadith it is permissible to recite the Holy Quran at the grave and the Fatwa is on this only. Fatawa A'alamgiri, Vol. 5, Pg. No. 350.

Shaykh Ibn Ul Hummam has also said that if one recites Surah Ikhlaas (Qul Huwallahu Ahad) 11 times and gift the reward (Isaal-e-Sawab) to the deceased, then that person will get the reward equal to the number of the deceased. (Dara Qutni, Miraqil Falah Ma'a Haashiya Al Tahtahawi, Pg. No. 622, Nur Ul Masabeeh, Vol. 4, Pg. No. 201)

Performing Sajdah to the grave, performing Tawaf of them, etc. are not correct and it is highly objectionable to do things which are not allowed by the Shariah.

Question: Assalamalaikum wa Rahmatullah wa barakutuhu,

Is getting a facial permissible in Islam? In facial, the face is massaged with some creams (facial creams), then steam is given and then bleaching is performed, which makes the face beautiful. Some women take pride in that they have gotten such and such a facial performed. Please throw light in the issue also.

.................................................................................................................................

Answer: Walaikum As Salaam Wa Rahmatullah Wa Barakutuhu,

As per what you have said in a facial some creams are applied, the face is massaged, steam is given and bleaching is performed, which makes the face beautiful. In the same way, to make the skin beautiful fairness creams are used. This method of makeup is permissible provided the creams used are not harmful in any way to the skin.

As makeup for women is permissible and commendable (Mustahab) in light of the Shariah, if the husband expresses a desire, removing the hair of the face is also permissible. As given in Radd Ul Muhtaar, Kitab Ul Khatr Wal Ibaha, Fasl Fin Nazri Wal Mass.

Makeup and beautifying oneself is permissible when it is not for the sake of pride, showing off, etc. Women should not use perfume and leave the house and should not intend to break any rule of the Shariah. If the woman, reveals herself to non-Mahram people with the makeup or any of the above-mentioned are found, then it will not remain permissible.

This allowance for makeup is only permissible and allowed and it is not obligatory or compulsory. Being occupied with makeup all the time and wasting time in this is not correct. This is only external beautification. Muslim women should make efforts for the permanent beautification of their inner selves. The Ummahatul Momineen (The mothers of the believers) and the ladies of that time did not concern themselves with external beauty. They were more concerned about the purification of their hearts, their thoughts and about the beautification of their inner selves and they advised others to do the same. Hadhrat Umar Farooq (May Allah be well pleased with him) said in his sermon:

Translation: Beautify yourselves for the big summons, when you will be presented and nothing of yours that is hidden will remain hidden. (Kanz Ul Ummal, Hadith No. 44203)

And Allah (Subhanahu Wa Ta'ala) knows best.

Mufti Syed Ziauddin Naqshbandi Qadri,

[Professor, Islamic Law, Jamia Nizamia,
Founder-Director Abul Hasanaat Islamic Research Center]

Question: If something is being sold and in all probabilities that article is a stolen good, then is it correct to buy that article as per the Shariah? If we have already bought it, then what does the Shariah say about it?
............................................................................

Answer: If it is highly probable that the article which we want to buy is a stolen good or else gained by force, then buying it is not correct as per the Shariah. The Holy Prophet (Sallallahu alaihi wa sallam) has given a stern warning about it:

Translation: Hadhrat Abu Hurairah (May Allah be well pleased with him) relates that the Holy Prophet (Sallallahu alaihi wa sallam) said: If any person buys a stolen good knowing it for what it is, that person is a partner in the ignominy and sin. (Shu’abul Imaan, Hadith No. 5258)

However, if in the market both kinds of goods are present – those which have been gained through lawful methods and those which have been gained through unlawful methods, and the goods gained through lawful methods are greater in number. Now, if a buyer is not sure about the good that he or she is buying whether it has been gained through lawful means or unlawful ones, then to ease matters the Shariah permits the buying of such a good. (Majma’ Ul Anhur..)

If a stolen good has been bought, then it is necessary to return it to its owner. If the owner cannot be ascertained, then giving it away in charity is necessary. Personal use is not permissible. As mentioned in Radd Ul Muhtaar, Vol. 5, Pg. No. 273)

And Allah Most High knows best.

Mufti Hafidh Syed Ziauddin Naqshbandi Qadri

[Professor, Islamic Law, Jamia Nizamia,
Founder-Director, Abul Hasanaat Islamic Research Center]

Especially on the occasion ofMawlid, mention the Holy Prophet (Sallallahu alaihi wa sallam) and become aware of His teachings so that through its blessings, the remaining 11 months are also spent acting upon the Shariah
